Compliance: What Gatekeepers Need to Know

To align with the DMA, gatekeepers must adhere to well-defined “do’s” and “don’ts.” These rules are designed to create transparency, fairness, and accountability in the digital ecosystem.

Key Obligations (“Do’s”):

• Enable interoperability with third-party services in specific scenarios.
• Provide business users with access to the data generated on the platform.
• Equip advertisers with tools for independent verification of ad performance.
• Allow business users to promote their services outside the platform.

Prohibited Practices (“Don’ts”):

• Favor their own products or services over third-party offerings in rankings.
• Restrict consumers from connecting with businesses outside the platform.
• Block users from uninstalling pre-installed software or apps.
• Track users for targeted advertising without obtaining effective consent.

Consequences of Non-Compliance: Non-compliance carries severe penalties, including fines of up to 10% of global annual turnover (or 20% for repeated infringements), periodic penalty payments, and even structural remedies like divestiture of business units.
