How to Achieve AVG Compliance?

Achieving compliance involves understanding your responsibilities and implementing the right measures. The Dutch Data Protection Authority (Autoriteit Persoonsgegevens) recommends a structured approach in 10 Steps to AVG Compliance:

1. Inventory Personal Data:
   Identify all personal data you process, such as names, addresses, phone numbers, and email addresses. For sensitive data like health records, stricter rules apply.
2. Establish a Legal Basis:
   Ensure you have a valid reason for processing data. This could be consent, a legal obligation, or the necessity to perform a contract.
3. Appoint a Data Protection Officer (DPO):
   Some organizations, such as public institutions or those processing sensitive data on a large scale, must designate a DPO to oversee compliance.
4. Conduct a Risk Assessment:
   If your data processing poses high risks (e.g., profiling or systematic monitoring), you must perform a Data Protection Impact Assessment (DPIA) to identify and mitigate potential issues.
5. Implement Privacy by Design and Default:
   Build privacy into your processes from the start. For example, ensure that consent checkboxes on forms are not pre-selected.
6. Maintain a Processing Register:
   Document what data you collect, why you collect it, how you store it, and who has access to it. This is mandatory for most organizations.
7. Secure Data Properly:
   Use robust technical and organizational measures, such as encryption, secure passwords, and access controls, to protect data from breaches.
8. Draft Data Processing Agreements:
   Ensure third-party vendors handling personal data comply with AVG by signing data processing agreements.
9. Provide Clear Privacy Information:
   Create an easy-to-understand privacy policy that explains how you handle personal data and informs individuals of their rights.‍
10. Prepare for Rights Requests:
    Be ready to handle requests such as access, correction, or deletion of data. You must respond promptly to ensure compliance.
